Terms of service

The terms you buy on. Written to be read, not to be got past.

1. Who you are buying from

This site is operated by Mitch Distribution Ltd, trading as Clearance Depot, a company registered in England & Wales under number 15439156, with its registered and trading address at Unit 4, Church Farm, Hoxne Road, Eye, Suffolk IP23 7NJ. Our VAT number is GB 474605086.

2. Who these terms are for

These terms apply when you buy from us as a consumer — that is, for purposes wholly or mainly outside a trade, business, craft or profession. Consumers have rights under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013 that these terms cannot reduce, and nothing here is intended to.

Buying pallets or bulk stock for resale is a separate business-to-business arrangement, agreed in writing with us directly, and is not covered by these terms.

3. What we sell

We sell clearance, end-of-line, overstock and short-dated branded goods, bought through legitimate UK trade channels. Everything we sell is genuine.

Quantities are limited and lines are not restocked. Stock levels shown on the site are live, but an item can sell out between you seeing it and completing checkout. If that happens we will not take your order — see clause 4.

Where an item's condition affects what you receive, we say so on the product page: damaged box, open box, short dated or last of the line. Those descriptions form part of the contract.

4. How a contract is formed

  1. You place an order by completing checkout and paying.
  2. Your order is an offer to buy. We confirm receipt by email, which is not yet acceptance.
  3. A contract comes into existence when we allocate stock and confirm your order as paid. If we cannot allocate stock — because the last one sold while you were paying — no contract is formed and we refund you in full.

We may also decline an order if we reasonably believe it is not for personal use, or if there has been an obvious pricing error.

5. Prices and payment

  • All prices shown include VAT at the applicable rate.
  • Delivery is free on orders of £50 and over, and £3.95 below that. The charge is shown in your basket before you pay.
  • Payment is taken by Stripe. We never see or store your card details.
  • “Was” prices shown alongside our own are the manufacturer's recommended retail price for that item.

We take care with pricing, but if an item is listed at an obviously incorrect price we will contact you before dispatching and you may confirm at the correct price or cancel for a full refund.

6. Delivery

Delivery terms, timings and the dispatch cut-off are on our delivery page and form part of these terms. Goods become your responsibility once they are delivered to the address you gave us.

7. Returns, cancellation and faulty goods

Our 30-day returns policy, your statutory 14-day right to cancel, and your rights if goods are faulty are set out in full on our returns page, which forms part of these terms. Those are three separate things and the page keeps them separate.

Return postage. Where you cancel or return an item because you have changed your mind, you bear the cost of returning it to us. Where an item is faulty, damaged in transit or not as described, we bear that cost. We are telling you this before you buy because the Consumer Contracts Regulations require us to — if we did not, we would have to pay.

8. Our liability

We are responsible for loss you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill.

We do not exclude or limit our liability in any way for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation;
  • breach of your legal rights in relation to the goods, including the right to receive goods that are of satisfactory quality, fit for purpose, as described, and match any sample or model shown to you; or
  • any other liability that cannot lawfully be excluded or limited.

We are not liable for business losses. If you use the goods for any commercial or business purpose, we have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.

9. Events outside our control

If something beyond our reasonable control prevents or delays us performing our obligations, we will contact you as soon as possible and take steps to minimise the delay. You may cancel and receive a full refund for anything you have paid for and not received.

11. Governing law

These terms are governed by the law of England and Wales, and disputes may be brought in the courts of England and Wales. If you live in Scotland or Northern Ireland you may also bring proceedings in your own courts.

12. Changes to these terms

We may change these terms. The version that applies to your order is the one published when you placed it. The date at the foot of this page shows when it last changed.
